Mail Metrics proposes a variety of offers that are referred in this Privacy Policy as the “Offer” or the “Offers”.

Processor on Behalf:
Mail Metrics provides various Offers to its business clients. In these cases, Mail Metrics acts only on the instructions of its “data controller” clients and does not control or share such data without direction from the client. Mail Metrics processes this data on the client's behalf. For such processing, Mail Metrics enters into appropriate agreements with the clients providing that the client is the data controller for the purpose of the Safe Harbor Program and is in compliance with the Safe Harbor Program Principles. In some very limited situations Mail Metrics may act as a data controller, in this situation Mail Metrics is required to comply with all Safe Harbor Principles.

Mail Metrics also collects information from individuals who visit Mail Metrics’ website. When expressing an interest in obtaining additional information about the Offer, Mail Metrics requires you to provide the Company with contact information, such as name, company name, phone number, and email address (“Required Data”). Mail Metrics may also ask you to provide additional information, such as job title or industry (“Optional Data”). Required Data and Optional Data are referred to as “Customer Data”.
Mail Metrics uses the data collected to perform the services requested. For example, if you fill out a “Contact” form, the Company will use the information provided to contact you about your interest in the service.
Mail Metrics may also use the data collected for marketing purposes. For example, Mail Metrics may use information you provide to contact you to further discuss your interest in Mail Metrics and to send you information regarding Mail Metrics.
3. Choice:
Mail Metrics provides the individuals with clear and conspicuous, readily available, and affordable mechanisms to exercise choice regarding the manner and circumstances in which the personal information will be used and shared with third parties (opt out).
When acting in the capacity of a Processor on Behalf where Mail Metrics receives transfers of personal information from the EU to the United State, Mail Metrics requires contractual provisions from the EU data controller that the personal information has been provided to Mail Metrics in accordance with the Safe Harbor Privacy Principles to ensure the individuals have been provided with appropriate choice regarding how their information may be used to comply with all Safe Harbor Principles
4. Onward transfer:
To disclose or transfer information to a third party, Mail Metrics apply the Notice and Choice principles described above.
Mail Metrics will make sure that the third party subscribes to the Safe Harbor Privacy Principles or is subject to the Directive or another adequacy finding. As an alternative, Mail Metrics will enter into a written agreement with such third party requiring that the third party provide at least the same level of privacy protection that Mail Metrics provides in its own Privacy Policy.
5. Security:
Mail Metrics has advanced security measures to protect “Customer Data” from loss, misuse and unauthorized access, disclosure, alteration and destruction. These measures and technologies help ensure that Customer Data is safe, secure, and only available to the individual to whom the information belongs and those to whom the individual has granted access. Mail Metrics hosts its Website in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders.
6. Data Integrity:
Mail Metrics takes reasonable steps to ensure that data is reliable for its intended use, accurate, complete, and current.
7. Access:
Any individual may contact Mail Metrics to learn whether or not information data relating to him or her is found in Mail Metrics’s databases and to correct, amend, or delete that information where it is inaccurate, except where the burden or expense of providing access would be disproportionate to the risks to the individual's privacy in the case in question, or where the rights of persons other than the individual would be violated.
